General Terms and Conditions (GTC)
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by consumers through our Darshan Nepal online store.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity.
By completing an order, the customer accepts these General Terms and Conditions in the version applicable at the time the order is placed.

3. Offer and Conclusion of Contract
The presentation of products in our online store does not constitute a legally binding offer to conclude a purchase contract.
The customer may select the desired products and add them to the shopping cart. Before completing the order, the customer can review and, if necessary, correct their information and the selected products.
By clicking the button to place a binding order, the customer submits a binding offer to purchase the goods contained in the shopping cart.
The contract is concluded once we accept the order. Acceptance may take place, in particular, by means of an order confirmation, shipping confirmation, or delivery of the ordered goods.
4. Products and Product Information
We primarily sell food, beverages, and other everyday consumer goods.
We make every effort to ensure that all product descriptions, images, ingredients, allergen information, weight information, and other product details are displayed as accurately and up to date as possible.
For food products, the information provided on the respective product packaging shall be authoritative. Customers are requested to carefully check the information on the product packaging before consumption, particularly in the case of allergies, intolerances, or special dietary requirements.
Product images may differ slightly from the product actually delivered due to changes in packaging or design.
5. Prices
All prices displayed in the online store are stated in euros and include the applicable statutory value-added tax (VAT), where applicable.
Shipping or delivery charges may apply in addition to the price of the goods. The applicable shipping and delivery charges will be displayed to the customer during checkout before the order is completed.
The total price displayed in the online store at the time the order is placed shall apply.
6. Shipping and Delivery
Delivery will be made to the delivery address provided by the customer during the ordering process and within the delivery areas offered by us.
The customer is responsible for providing a complete and correct delivery address.
The available shipping methods, shipping costs, and, where applicable, estimated delivery times will be displayed during the ordering process.
Unless a binding delivery date has been expressly agreed, any delivery times stated are generally estimated delivery times.
7. Shipping Based on Weight
The available shipping methods and shipping costs may depend on the total weight of the order.
If an order exceeds the maximum weight permitted for the respective shipping service or delivery area, a standard shipping option may not be available.
In such cases, the customer may be asked to reduce the quantity ordered or to contact us regarding an individual shipping arrangement.
8. Acceptance and Delivery of Food Products
The customer must ensure that the delivery can be accepted at the delivery address provided.
This applies in particular to perishable, refrigerated, or other food products for which prompt acceptance is necessary.
If a delivery cannot be properly completed due to an incorrect or incomplete address for which the customer is responsible, or because the delivery cannot be accepted, the applicable statutory provisions shall apply.
9. Returns of Food Products
Due to the particular nature of food products, certain products cannot be returned after delivery, particularly where the right of withdrawal is excluded by law.
This may apply in particular to goods that are liable to deteriorate or expire rapidly.
For products that are not suitable for return for reasons of health protection or hygiene, the right of withdrawal may, subject to the applicable statutory requirements, be excluded in particular where the relevant seal has been removed after delivery.
Any statutory right of withdrawal and the customer's statutory rights in the event of defective, damaged, or incorrectly delivered goods remain unaffected.
10. Right of Withdrawal
Consumers generally have a statutory right of withdrawal unless this right is excluded under applicable law.
For certain food products, there may be no right of withdrawal pursuant to Section 312g (2) of the German Civil Code (BGB). This applies in particular to goods that are liable to deteriorate rapidly or whose expiry date would quickly be exceeded.
Further statutory exceptions to the right of withdrawal may also apply.
Where a right of withdrawal applies to an order, the information contained in our separate Withdrawal Policy (Widerrufsbelehrung) shall apply.
These General Terms and Conditions do not replace any legally required Withdrawal Policy.
11. Damaged, Defective, or Incorrectly Delivered Goods
The customer's statutory warranty rights remain fully applicable.
If a product is damaged, defective, spoiled, incorrectly delivered, or otherwise does not correspond to the order, we ask the customer to contact us as soon as reasonably possible.
To help us process the matter more quickly, it may be useful to provide the following information:

Where appropriate, photographs of the product and/or packaging
Providing this information is not a prerequisite for exercising the customer's statutory rights.
After reviewing the circumstances of the individual case, the matter will be handled in accordance with the applicable statutory provisions.
12. Best-Before Date and Use-By Date
For food products, customers must observe the best-before date or use-by date stated on the packaging, as well as the applicable storage and handling instructions.
After receiving the delivery, the customer is responsible for storing and handling food products in accordance with the requirements stated on the respective product.
13. Allergens and Ingredients
Information regarding ingredients and allergens provided in the online store is supplied to the best of our knowledge.
As manufacturers may change recipes, ingredients, or packaging, customers should always check the current information and labelling on the delivered product packaging before consumption.
This is particularly important for persons with food allergies or intolerances.
If there is any uncertainty, the product should not be consumed until the relevant product information has been checked.
14. Availability of Goods
All offers are subject to the availability of the respective products.
If an ordered product is exceptionally unavailable after the contract has been concluded, we will inform the customer accordingly and handle the matter in accordance with the applicable statutory provisions.
Any payments already made for goods that are not delivered will be refunded where required.
15. Payment Methods
The payment methods available in the online store will be displayed during the ordering process.
Depending on availability, these may include electronic payment methods and payment options provided by Shopify and/or the integrated payment service providers.
Additional terms and conditions of the respective payment service provider may apply to individual payment methods.
16. Retention of Title
The delivered goods remain our property until the purchase price has been paid in full.
17. Warranty
The statutory provisions concerning liability for defects shall apply.
The customer's statutory rights in relation to defective goods are not restricted by these General Terms and Conditions.
18. Liability
We shall be liable in accordance with the applicable statutory provisions, in particular for damages resulting from injury to life, body, or health, as well as for damages resulting from intentional or grossly negligent conduct.
In all other respects, the statutory liability provisions shall apply to the extent permitted by law.
Mandatory statutory liability provisions, in particular those under the German Product Liability Act (Produkthaftungsgesetz), remain unaffected.
19. Data Protection
Personal data will be processed in accordance with the applicable data protection laws.

20. Final Provisions
The laws of the Federal Republic of Germany shall apply, subject to mandatory consumer protection provisions.
For consumers whose habitual residence is outside Germany, mandatory consumer protection provisions of the country of their habitual residence shall remain unaffected insofar as they are applicable by law.
Should any individual provision of these General Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
